Terms and Conditions

1. General
This website is operated by PromoMate Australia Pty Ltd. Throughout the site, the terms “we”, “us” and “our” refer to PromoMate Australia Pty Ltd. The terms “you”, “your”, or “Customer” refer to any person, company, or organisation placing an order or interacting with our website or services.
By accessing or using this website and/or placing an order with us, you agree to be bound by these Terms & Conditions, along with our Privacy Policy and any additional policies linked throughout the site.
2. Orders
All orders must be confirmed in writing and include a valid purchase order number. Receipt of a written confirmation constitutes your acceptance of these Terms & Conditions, regardless of any conflicting terms submitted by you.
We reserve the right to accept or reject any order at our sole discretion.
3. Payment Terms
Payment is required prior to order processing unless credit terms have been pre-approved by PromoMate. All goods remain the property of PromoMate until full payment has been received and cleared.
Approved credit accounts must be paid within 30 days of invoice. Credit terms may be withdrawn at any time without notice. Initial orders from new customers are strictly payment in advance unless otherwise arranged.
Invoices overdue by 14 days or more may result in withholding delivery or suspension of service. Interest may be charged at 2% per month on overdue accounts. We reserve the right to recover debt through legal or third-party collection processes, and you agree to cover any associated recovery costs.
4. Quotations & Pricing
All quotes are valid for 30 days unless otherwise stated in writing. We reserve the right to change prices, specifications, or product details without notice. Every effort is made to provide accurate product descriptions, however we are not liable for any errors, omissions, or losses arising from misinterpretation of product listings.
All pricing is in Australian Dollars (AUD) and excludes GST unless otherwise specified.
5. Delivery
We use various national courier services for delivery across Australia. All quoted delivery times are estimates only. PromoMate is not liable for delays or losses caused by third-party carriers or customs agencies.
Express delivery may be available and is subject to additional fees. Orders are shipped using our courier accounts unless prior pickup arrangements are made from our Wangara, WA premises.
6. Material & Quantity Variations
Due to the nature of custom manufacturing, a variance of ±10% in quantity may occur. You will be invoiced based on the actual quantity delivered at the quoted unit rate.
Reasonable variations in fabric, finish, colour, size, and materials may occur and do not constitute grounds for rejection of the goods. Sample items provided must be returned in original condition within 7 days, or charges may apply.
7. Cancellations
Order cancellations must be made in writing and may be subject to charges for work already completed, including artwork, setup, or material costs incurred up to the date of cancellation.
8. Claims & Returns
Claims for damages, faults, or shortages must be made in writing within 7 days of receiving the goods. Products must be inspected at the time of delivery. Claims will only be considered where there is a manufacturing defect or a confirmed printing error.
Faulty goods must be returned for inspection. Refunds or replacements will be issued at our discretion once the fault is verified. PromoMate is not responsible for damage in transit unless clearly noted on the delivery docket upon receipt. Please visit our Return and Refund Policy Here
9. Limitation of Liability
To the maximum extent permitted by law, our liability is limited to the replacement cost or refund of the goods supplied. We are not liable for indirect, incidental, or consequential losses arising from delays, misprints, or faulty goods.
These Terms do not limit your rights under Australian Consumer Law where applicable.
10. Intellectual Property
By submitting artwork, logos, or content to be used in the production of goods, you warrant that you own or have permission to use the intellectual property involved. PromoMate accepts no liability for unauthorised use of copyrighted or trademarked material provided by the customer.
11. Force Majeure
We are not liable for failure to perform our obligations due to events beyond our control, including but not limited to natural disasters, supply chain issues, strikes, government restrictions, or pandemics. In such cases, we reserve the right to delay or cancel the contract without liability.
12. Phone Call Monitoring
Telephone calls may be recorded for training, quality control, and security purposes.
13. Personal Information
All personal information collected through the website or ordering process is handled in accordance with our Privacy Policy.
14. Governing Law
These Terms & Conditions are governed by the laws of Western Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
